| Can my landlord fine me $50 for cigarette butts on the ground? Our balcony is right in front of the parking lot and sidewalk where people enter the building. We received a notice that there are cigarette butts on the ground below our balcony. It states we have 5 days to clean these up or else we will be fined $50. The problem is how do I even know they are ours? We are usually very careful about making sure they are taken care of and many times I will notice that people will flick or put our their cigarettes on the ground or surrounding area just before they enter the building. So the butts in question most likely do not even belong to us. Can they legally enforce a $50 fine if we don't pick them up? I read through our lease and no where does it say anything about fines.... |
| I couldn't stand my landlord but I also couldn't stand people's cigarette butts littering the parking lot and front of the building. This is one of the few things my imbecile landlady would not fine for because most of the people doing it were "section eights" and she was terrified of them. Instead, she would have the poor super clean them up. You're saying it's not you. OK, fine. It's not in the lease either. I wouldn't pay it. If they persist I would get a lawyer to tell them. I'm the type of person who would pay a lawyer $500 just to avoid paying some assh--e landlord fifty bucks. Are they singling you out or are they going to all the smokers in your building and fining them? That still wouldn't be legal but it would be more understandable than them deciding arbitrarily that it's you. People try a lot of dumb s--t to get money out of others. In most cases you can hear the judge laughing from ten miles away as he/she bangs the gavel down and dismisses the case. EDIT: The answers from the other two posters are intelligently thought out and I understand where they coming from. I don't agree, however. If there is no sign and it's not in the lease it does not make a bit of difference if they are yours or not. You don't have to pay and I would not pay it. These landlords get away with entirely too much manipulative bulls--t so don't give in. I've been there and I know. |

I know smokers are getting fined in the UK for tossing cigarette butts on the ground just while outside walking around, but I have never heard of that happening in the US or Canada.
